Fighting Breath & Blood Test Evidence

Breath and Blood Alcohol Tests Can Be Unreliable

If you need a lawyer to challenge blood and breath test results and fight for your rights after a DWI arrest, call me. My name is Hank Judin. I am a Dallas criminal defense attorney with almost 30 years of experience helping clients in the Dallas-Fort Worth Metroplex and throughout North Texas fight unfair charges, inaccurate evidence and overzealous police and prosecutors.

In many DWI cases, police and prosecutors will tell the defendant that they have all the proof they need to get a conviction, based on a breath test or blood alcohol test. Do not be fooled into accepting an unfavorable plea agreement. The burden of proof is on the prosecution, and it is possible in many cases to mount a determined legal challenge to blood and breath test evidence. I Will Challenge Inaccurate Blood and Breath Test Results

The Intoxilyzer 5000 is the most common field breathalyzer model in use in North Texas. National studies have shown that these machines are often almost useless when determining whether or not a driver is actually impaired. There are serious problems with required maintenance and calibration. Also, many police officers are not sufficiently trained to administer the test properly.

Most people assume that if a blood test says they had over the legal limit of .08 blood alcohol content (BAC), then it must be true. The fact is there are often serious flaws in the way blood alcohol tests are conducted. The blood draw can be done improperly, tainting the sample. The way a test is processed can render the results unreliable. At every stage of the process there is a chance of human error or technological breakdown.

Just because the police and prosecutor say they have "iron-clad" evidence that you were driving under the influence, that does not mean you should simply give up and plead guilty. An experienced and dedicated attorney may be able to successfully challenge blood and breath test evidence.
